Records Information

The only statements of consideration that will be accepted on a Surface Deed or Affidavit of Affixation are one of the following:

• A statement of full consideration paid for the property conveyed.
• A statement designating one of the exemptions in subsection 6 which the grantee believes applies to the transaction.

Legibility

Documents must be considered legible by the recorder.

Margins

All documents must have a three (3) inch blank margin across the top of the first page for recording information. If not provided, the recorder shall add a page and an additional page charge must be levied in accordance with NDCC. Submitters can add a cover page with the title of the document at least three inches from the top to serve as the first page.

All documents must have a one inch margin on one edge of each page to allow space for the recorder to affix bar codes. A fee of $10 can be assessed if the proper side margin is not provided.

Font

The minimum font size accepted must be equal or larger than ten point Calibri. Documents will be rejected if they don’t meet the minimum font size requirement unless the form was issued by a government agency.
